PRIVACY POLICY

The Ogden Museum of Southern Art (“OMSA”) is committed to protecting the privacy of our visitors. This privacy policy governs the way we collect and use information both online and offline, including at ogdenmuseum.org and its subdomains, websites accessed through your mobile devices as well as downloadable mobile applications (“Websites”). A link to this policy is included in the footer information on every page of the Websites. Your use of the Websites or provision of personal information to OMSA as described below constitutes your agreement to the terms of this privacy policy.

Personal Data
The term “personal data” includes information such as your name, address, email address, telephone number, IP address, credit card information, website cookies and location. Personal information does not include data from which you can no longer be identified due to encryption or anonymity.

Rights to your Personal Data under the General Data Protection Regulation (GDPR)
If the GDPR applies to you, then you have particular rights as an individual under this regulation, including the right to:

  • Request access to your personal data stored by OMSA and request certain information in relation to its processing;
  • Request a change and/or update be made to your personal data stored by OMSA; and
  • Request restriction of processing of your personal data;
  • Request erasure of your personal data stored by OMSA ; and
  • Object to the processing of your personal data.

To request any of the above, please write to privacy@ogdenmuseum.org.  We will contact you to verify your identity, and then fulfill your request within 72 hours.

Cookies and Pixel Tags
The Websites use technologies such as “cookies” and “pixel tags” to improve the functioning of our website and your experience. Cookies are small data files that are automatically sent to your browser from a Web server and stored on your computer’s hard drive. Cookies enable us to personalize your experience. “Pixel tags” are tiny graphical images embedded in webpages. Pixel tags are used to determine what parts of a website a visitor has viewed. These technologies do not contain any personal information about you; they are used to gather information to analyze traffic to the Websites, to improve our content and navigation, to enhance our marketing efforts and to personalize your experience.

The Museum also works with third-party analytics and marketing partners who use technologies such as cookies and pixel tags on our behalf. For details, see Third-Party Service Providers.

You may choose to set your browser so that it does not accept cookies. Most areas of the Websites will function without cookies, but cookies may be required if you wish to register, sign in or place items in your shopping bag. For an optimal experience with our site, we recommend that you allow cookies.

Email Communication
OMSA regularly sends email to subscribers to OMSA newsletter. Email recipients may opt out at any time by following the “unsubscribe” instructions included in the email message. If you have previously unsubscribed from OMSA’s email communications and wish to resubscribe, please email info@ogdenmuseum.org to receive resubscription verification.

How We Collect and Use the Information You Provide
We collect and use the information you provide to personalize the Websites so that we can better meet your needs, fulfill your online order, facilitate customer service, inform you of products and promotional offers, analyze trends and collect statistics. We maintain the data that you provide, in secure databases. Our collection and use of visitor information varies with the type of visit or transaction. When You Purchase a Product, Catalogue or Tickets to an Event
We use First Data® for settlement of sales of our products, catalogues and the purchase of event tickets. If you purchase a product, catalogue or an event ticket on the Website, you will be directed to the PayPal website for settlement. The personal information that you provide via our secure gateway that is necessary to fulfill your online order, if you do not have an existing  account, may include your name, address, telephone number, email address and credit card number. Credit Card information does not reside on our servers, but resides on the First Data servers. First Data then sends us a confirmation of the sale including your name and address, which we then use for shipment purposes. We do not use this information for any other purpose. When You Register
You may use the Website without registering or submitting any personal information. However, you may subscribe to receive our free email newsletter as well as subscribe to our direct mail mailing list for other communications that we send out on a periodic basis. Subscribers to our email newsletter and mailing list may opt out at any time by following the “unsubscribe” instructions included in each email message.

We use Constant Contact® to facilitate your subscription to our email newsletter and/or direct mail mailing list. The Terms of Service and Privacy Statement, for Constant Contact may be found at https://www.constantcontact.com/legal/privacy-statement. We do not share personal information with third parties.

Emailing the Museum
If you email the Museum, any message, material, business information, ideas, concepts or other information sent to the Museum by email will be treated as non-confidential and non-proprietary.

Third-Party Service Providers
OMSA engages reputable third-party vendors in order to help us manage the Websites, process transactions, better respond to the needs of our visitors, and enhance our marketing efforts. This includes third-party analytics vendors such as Google Analytics and other marketing partners. We and our third-party vendors or partners use analytics data for a variety of purposes such as to improve the design and content of our Websites, to help us learn things like what pages are most attractive to all of our visitors and what exhibitions and programs visitors are interested in, and to gauge the success of our advertising and marketing campaigns.

OMSA requires its vendors to maintain the confidentiality of the information to which they are provided access, and restricts these vendors from using or disclosing the information in any way without express authorization by OMSA.

Share Features
OMSA uses third-party tools to give you easy ways to share our content with others. The information you provide when using these tools is subject to the third parties’ privacy policies.

Children Under Thirteen Years of Age
OMSA takes special care to protect the safety and privacy of children. We do not knowingly collect personal information from children under thirteen years of age.

Data Security
OMSA makes every reasonable effort to ensure the security of transactions that occur on the Website. To maintain data accuracy, to prevent unauthorized access, disclosure, alteration and destruction of personal information, and to ensure the correct use of personal information, we have put appropriate physical, electronic and administrative procedures in place to safeguard and secure the personal information that we collect online. Notwithstanding our efforts, we cannot guarantee absolute or unqualified protection of this information given the open nature and resulting instability of the Internet, and we make no representations or warranties as to the effectiveness of our security, and we assume no liability for security breaches or any failure in the security of your computer equipment and network, your Internet service provider or other networks and communications providers.

Social Media Comment Policy

Ogden Museum of Southern Art welcomes your comments and appreciates your engagement, feedback and opinions on our social media platforms. 

Ogden Museum utilizes the following social media platforms: 

While informed debates in an open, respectful forum will always be allowed on our social media platforms, content must be courteous, inoffensive and appropriate for all ages.

You are responsible for the content of your comments. To protect your own privacy and the privacy of others, please do not include names, phone numbers, email addresses, or other identifying personal information in public messages. If you need to provide personal information, please send us a private message. 

The views of members of the public who post on Ogden Museum’s social media channels do not necessarily represent the views of the Museum and we cannot guarantee the accuracy of these messages.

All comments will be monitored and/or moderated by Ogden Museum Monday to Friday. Comments posted outside of these hours will be read and addressed as early as possible. 

Ogden Museum will not tolerate messages that are offensive to an individual or organization, or abusive. 

Ogden Museum reserves the right to refuse, hide or delete any messages, links or images that meet any of the following conditions: 

  • Racist, hateful, sexist, homophobic, transphobic, slanderous, insulting, or life-threatening messages
  • Messages that contain name-calling, personal attacks and/or defamatory statements
  • Serious, unproven, or inaccurate accusations against individuals or organizations
  • Abusive, aggressive, coarse, explicit, vulgar, violent, obscene or pornographic messages
  • Messages that infringe on copyrights
  • Messages for advertising purposes
  • Messages that suggest or encourage illegal activity
  • Unintelligible or irrelevant messages
  • Intentional trolling, troll baiting or flaming
  • Messages not sent by the author and/or posted by anonymous or robot accounts
  • Similar or identical messages posted by single or multiple users
  • Messages that do not, in our opinion, add to the normal flow of conversation/debate.

Violations of these guidelines may cause the author to be blocked from Ogden Museum’s social media channels.

In the case of ongoing investigations or legal proceedings, we will not be able to comment.
